PERSONAL DATA Under the provisions and effects of Legislative Decree no. 196 of 30 June 2003 (Code on the Protection of Personal Data), we wish to inform you that the personal data which you have voluntarily made available to Nuovo Trasporto Viaggiatori S.p.a. (also referred to, hereinafter, as the "Company" or "NTV") shall be processed in accordance with the rules and regulations currently governing the protection of personal data, as well as with the principles of confidentiality that underlie the Company’s operations. 1. Purposes of the processing The personal data that you make available to NTV may be used for the sending of our newsletter. 2. Processing procedures Your personal information shall be processed using suitable paper, electronic and/or telematic tools whose logics are closely tied to the above purpose and which are able to guarantee the security and confidentiality of the data being processed. 3. Presentation of the data and consequences of a refusal to do so Presentation of your personal data is optional. Nevertheless, refusal to present the data, and/or the presentation of data that proves to be inexact and/or incomplete, could prevent from sending/receiving our newsletter. 4. Communication of the data Your personal data could come to the knowledge of the shareholders, the members of the board of administration or another administrative organ, as well as the members of the board of auditors, the outside auditors and the company personnel (in particular the employees of the Marketing, Sales and Services Department and of the Information Systems Department), plus any other managers – internal and/or external – designated by NTV, in addition to the individuals assigned by the Company to process the personal information, in the course of carrying out their assigned tasks. Your personal data may also be communicated to any qualified subjects that provide NTV with work or services that contribute to reaching the ends indicated under paragraph 1 above, such as, to give some examples, parent companies, subsidiaries, companies in which holdings are possessed and/or associated enterprises; subjects, organisations and/or companies that manage and/or participate in the management and/or maintenance of the internet sites and electronic and/or telematic instruments used by NTV; suppliers, contractors, subcontractors, or other qualified subjects that provide the Company with works or services that contribute to the management and sending of our newsletter; consultants who assist the Company in various capacities, in particular with regard to legal affairs, tax matters, social security, accounting and organisational activities; any other subject whose data whose data must be communicated, under an express provision of the law. Your personal data may also be transferred abroad, in accordance with the pertinent rules and regulations currently in force, and even to countries that are not members of the European Union, should the Company decide to pursue its interests therein. 5. Distribution of data Your personal data shall not be distributed. 6. Rights of the interested party With respect to the processing operations referred to above, you may exercise the rights contemplated under art. 7 of Legislative Decree no. 196 of 30 June 2003, which, for your convenience, we have transcribed in full below: Legislative Decree no. 196 of 30 June 2003 ART. 7 – RIGHTS OF ACCESS TO PERSONAL DATA AND OTHER RIGHTS 1. The interested party is entitled to obtain confirmation of whether or not personal data regarding him or her exist, even if the data are not yet registered, and to receive communication of the data in intelligible form. 2. The interested party is entitled to obtain indication of: a) the origin of the personal data; b) the purposes and procedures of the processing; c) the logic applied, in the case of processing performed with the aid of electronic instruments; d) identifying information on the titleholder, the managers and the representative designated as per article 5, paragraph 2; e) the subjects or categories of subjects to which the personal data may be communicated, or which may gain knowledge of the data in their capacity as designated representative within the territory of the Italian State, or as managers or assigned personnel. 3. The interested party is entitled to obtain: a) the updating or correction of the data, or, when the party has an interest in doing so, the addition of further data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose preservation is not necessary for the purposes for which the data have been collected or subsequently processed; c) certification that the operations referred to under letters a) and b) above, together with their contents, have been brought to the attention of those to whom the data have been communicated or distributed, except in cases where fulfilling this obligation proves impossible or entails a use of resources clearly disproportionate to the right being safeguarded. 4. Titleholder and Manager of the processing The titleholder of the processing is the company Nuovo Trasporto Viaggiatori S.p.A., with registered office in Rome, at no. 149/B Viale del Policlinico. The Manager of the processing of the personal, on behalf of the Company, is Mr. Adriano Tomaro, domiciled, for the purposes of the position held, at the registered office indicated above. The Manager of the processing is responsible for responding to the interested party with regard to the exercise of the rights indicated above; any request for personal data processed by Nuovo Trasporto Viaggiatori S.p.A. may be presented to the aforementioned Manager at the Company’s registered office, or by writing to the electronic-mail address privacy@ntvspa.it The updated list of the Managers is available at the Company’s premises and can be consulted by presenting a specific request formulated in accordance with the procedures indicated above.
